The prices listed in the fotomaterial.sk e-shop include VAT and are valid at the time of order. We update prices continuously and reserve the right to make mistakes.

Sales of commission (used - secondhand) goods do not include VAT.

Terms and Conditions

These General Terms and Conditions (hereinafter referred to as the GTC) govern the rights and obligations of the contracting parties arising from the purchase contract concluded between the merchant and the buyer, the subject of which is the purchase and sale of goods on the fotomaterial.sk website as the merchant's electronic store. 

The merchants selling in the fotomaterial.sk online store are

whereby the trader Sc’art sells second-hand (used) goods, which are clearly marked with the word “secondhand”, and the trader Alena Čiffáryová sells other goods.

The Buyer is any individual who, outside the scope of his business activity or outside the independent exercise of his profession, concludes a contract with the trader or otherwise deals with him. By submitting an order, the Buyer confirms that he has familiarized himself with these GTC before concluding the contract and that he expressly agrees with them, in the wording valid and effective at the time of submitting the order.

Presentations of goods placed in the web interface of the store www.fotomaterial.sk are for informational purposes only. The Buyer places the selected goods in the shopping cart and fills out the order form. Before sending the order, the Buyer may check all entered data and, if necessary, change or edit them. The Buyer places the order by clicking on the "Pay now" button. After this action, it is not possible to change or edit the order subsequently. The purchase contract is not concluded by sending the order to the Buyer. The purchase contract is concluded at the moment when the Merchant confirms the Buyer's order. At this moment, mutual rights and obligations arise between the Buyer and the Merchant, which are defined by the purchase contract and these GTC, which are an integral part of it. The conclusion of a purchase contract without agreeing on all its requirements set out in the Civil Code is excluded pursuant to the Civil Code. After completing the order, an email confirmation of the order will be sent to the Buyer immediately.

Ownership of the goods

By the purchase contract, the Merchant undertakes to hand over the goods that are the subject of the purchase to the Buyer and to enable him to acquire ownership of them, and the Buyer undertakes to take over the goods and pay the purchase price to the Merchant. The Merchant reserves the right of ownership to the thing, while the Buyer becomes the owner only upon full payment of the purchase price. The Merchant hands over the goods to the Buyer together with the documents belonging to them and enables him to acquire ownership of the goods in accordance with the contract. The goods are handed over to the Customer at the moment the carrier delivers them to him.

The merchant reserves the right not to confirm the customer's order or the right to withdraw from an already concluded purchase contract if he finds that the price of the ordered goods was stated on the seller's website due to an obvious technical or other error, in particular because of its significantly lower amount compared to the regular amount, and there was no special notice of a special promotion or discount for such goods with the goods.

Delivery methods: by sending the package by a shipping company directly to the address, by sending the package to the shipping company's delivery point or by picking up the goods in person.

Withdrawal from the purchase contract

When purchasing online, you have the right, pursuant to Act No. 102/2014 Coll. on Consumer Protection, to withdraw from the purchase contract within 14 days from the moment you receive the goods, whether at the collection point or from the transport service. 

If you wish to withdraw from the contract and return the goods, please contact us in advance at 0917 736 899 or by email at fotomaterial@fotomaterial.sk. You can then send the goods to Fotomaterial.sk, Cesta na Senec 18, 821 04 Bratislava. Once we have received and checked the goods, we will refund your payment. 

In the event of withdrawal from the contract, it is necessary to return the goods undamaged, without signs of use or wear, in the original packaging and with complete accessories. If these conditions are not met, we are entitled to apply compensation for the reduction in the value of the returned goods in the form of a deduction from the amount we will refund to you.

Complaints

Complaints apply to goods with a manufacturing defect that becomes apparent within the warranty period of 24 months, unless the manufacturer's warranty period is longer (for example, 5 years in the case of Kalahari photo bags). The warranty period begins at the moment of receipt of the goods by the buyer. The warranty does not apply to goods damaged by improper handling or poor storage, as well as to goods worn out by normal use.

In the event of a complaint, please contact us in advance by phone at +421 917 736899 or by email at fotomaterial@fotomaterial.sk.

Then pack the goods, for example in the box in which we sent them to you, and take them to any Packety distribution point. Tell them the PIN: 96007645, they will stick a label and send the package. You will not pay anything.

After receiving the goods, we will either refund your payment, file a complaint with the manufacturer, or send you a new item (the procedure depends on the type of goods).

What to do if the delivered goods are damaged?

If the carrier delivers a shipment that has visible signs of manipulation, is unpacked, unsealed and resealed or mechanically damaged - the package is deformed, do not accept the shipment under any circumstances and call us at +421 917 736 899.
